1. Provider and Contractual Partner

These Terms & Conditions apply to all contracts concluded between:

and consumers within the meaning of applicable EU consumer protection laws.

2. Scope of Application

These Terms & Conditions apply to all orders placed via the website [DOMAIN], regardless of the customer’s place of residence within the European Union.

Any deviating terms of the customer shall not apply unless expressly agreed.

3. Business Model (Dropshipping)

Hommox operates an online store based on a dropshipping model. This means:

• Hommox sells products in its own name.
• Products are not stored by Hommox.
• Shipping, logistics, and return logistics are handled directly by third-party suppliers.

4. Conclusion of Contract

• Product presentations on the website do not constitute binding offers.
• By placing an order, the customer submits a binding offer to purchase.
• The contract is concluded only upon order confirmation by Hommox.
• Order confirmation is sent electronically.

5. Prices, Taxes and Invoicing

• All prices include applicable statutory VAT.
• Shipping costs, if any, are displayed separately during checkout.
• Invoices are issued exclusively by Hommox and provided electronically.

6. Payment Terms

Payment is made using the payment methods offered during checkout. Hommox reserves the right to exclude certain payment methods.

7. Delivery

• Delivery is carried out directly by third-party suppliers.
• Delivery areas: Germany and the European Union.
• Stated delivery times are non-binding estimates.
• Partial deliveries are permissible if reasonable for the customer.

8. Transfer of Risk

For consumers, the risk of loss passes upon delivery of the goods to the customer.

9. Retention of Title

Goods remain the property of Hommox until full payment has been received.

10. Right of Withdrawal

Consumers have a statutory right of withdrawal within 14 days. Details are provided in the Withdrawal Policy.

11. Returns

• Returns are governed by the Withdrawal Policy.
• Return logistics are handled by the respective supplier.
• Return shipping costs are borne by the customer where legally permissible.
• Unpaid or unauthorized returns will not be accepted.

12. Warranty

• Statutory warranty rights apply.
• Hommox does not provide any guarantees unless explicitly stated.
• Customers are requested to report defects immediately after receipt of the goods.

13. Liability

Hommox shall be liable without limitation in cases of intent and gross negligence. In cases of simple negligence, Hommox shall only be liable for breaches of essential contractual obligations. Liability is limited to foreseeable, contract-typical damages.

14. Supplier Responsibility

Third-party suppliers are responsible for:

• shipping and logistics
• packaging
• transportation
• return handling

Hommox shall not be liable for breaches of duty by suppliers, to the extent legally permissible.

15. Product Descriptions

Product images and descriptions are for illustrative purposes only. Minor deviations do not constitute a defect.

16. Reviews

Customer reviews reflect personal opinions. Hommox assumes no responsibility for the content of reviews.

17. Data Protection

Personal data is processed in accordance with the Privacy Policy.

18. Governing Law

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the customer’s country of residence remain unaffected.

19. Jurisdiction

Where legally permissible, the place of jurisdiction shall be the registered office of Hommox.

20. Severability Clause

If any provision of these Terms & Conditions is or becomes invalid, the remaining provisions shall remain effective.
